Terms of Use

Effective date: October 28, 2026

These Terms of Use ("Terms") are between you and Skydrop Apps LLC, 14767 NW Cosmos St, Portland, OR 97229, United States ("DrinkByMe," "we," or "us"). They govern the DrinkByMe iOS app and App Clip (together, the "App"). The English version governs.

1. Acceptance

By downloading or using the App, you agree to these Terms and the Safety Disclaimer at drinkbyme.com/safety. If you do not agree, do not use the App.

During onboarding, the App shows links to these Terms and the Privacy Policy with the notice: "By continuing, you agree to the Terms of Use and Privacy Policy."

2. Apple terms

The App is licensed through Apple's App Store, not sold. These Terms supplement Apple's Standard End User License Agreement. If they conflict about the licence, Apple's EULA governs.

Apple is not a party to these Terms and is not responsible for the App.

3. Eligibility and age

The App Store age rating is 18+. You must be at least 18 to use the App. There is no parental-consent path for anyone under 18.

Alcoholic recipes and ingredients are shown only to users who confirm they are 21 or older. Users aged 18 through 20, and anyone who chooses Under 21, get the mocktail-only experience. The App uses 21 as its alcohol-content rule everywhere it is distributed.

The Age Gate uses a self-declared Age Bracket and does not verify identity or exact age. You must answer truthfully. A missing answer is treated as Under 21.

If you select 21 or Older during onboarding, the App asks Apple's Declared Age Range service for a best-effort result. The App may switch the Age Bracket to Under 21 if Apple returns a range with an upper bound below 21. A declined, unavailable, or inconclusive result does not replace your answer. In Profile, switching to Under 21 is immediate. Switching to 21 or Older requires a typed self-confirmation.

You must follow the laws where you live and use the App. The App is not offered in mainland China or storefronts where alcohol-related apps or content are prohibited.

4. Licence

We give you a limited, personal, non-exclusive, revocable licence to use the App for non-commercial purposes on Apple devices you own or control. You may also use it through accounts permitted by Apple Family Sharing or volume purchasing, where available. Except for those Apple-permitted arrangements, the licence is non-transferable.

The App, its design, software, compilation, and branding are proprietary.

5. Premium, subscriptions, and Lifetime Access

The App has no free tier. After onboarding, you need Premium to use it. Premium is held by an active free trial, an active subscription, or Lifetime Access. There are no accounts: Premium is tied to your Apple ID purchases and restored with Restore Purchases.

Premium is offered as a Monthly plan, a Yearly plan, or Lifetime Access. Plans, billing periods, and prices are shown in the App before you buy. Payment is charged to your Apple ID account when you confirm the purchase.

Monthly and Yearly renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel them in your Apple ID subscription settings, which the App opens from Settings > Premium > Manage Subscription. Changing between Monthly and Yearly takes effect at the next renewal.

The Yearly plan may include a free trial of 7 days for eligible new subscribers. Apple decides eligibility, and its terms are shown in the App before you subscribe. Unless you cancel at least 24 hours before the trial ends, the trial converts to the paid Yearly plan. Any unused part of a free trial ends when you buy a subscription. If you allow it, the App schedules a local reminder on your device before the trial ends. The reminder is optional and the App sends nothing to us for it.

Lifetime Access is a one-time purchase that does not renew. It gives Premium for as long as the purchase remains valid, subject to Apple's refund and revocation rules. It does not cancel an existing subscription, so the App does not offer Lifetime Access while an auto-renewing subscription is still running, including one you have canceled but that has not yet ended.

Apple is the seller for in-app purchases. Apple handles refunds under its policies, including any EU withdrawal rights that apply through Apple. We do not promise separate refunds. Price changes follow Apple's notice process.

6. Recipes, illustrations, and other content

Recipes and related information are for general information and home preparation. They do not promise a particular taste, result, safety level, nutrition value, or alcohol content. Read the Safety Disclaimer.

The App includes curated cocktail and mocktail recipes. Ingredient lists and methods describe facts. Recipe descriptions use our own wording, adaptations are labelled, and credits are kept where a named creator is known. Recipe Source information may identify a Classic, the International Bartenders Association, a named creator, a DrinkByMe Original, or a DrinkByMe Adaptation. Some source links point to Liquor.com.

Product and brand names are trademarks of their owners and are used only to identify ingredients. No endorsement is implied.

Bundled recipe cover images are AI-generated illustrations made with Gemini or ChatGPT image tools. They are not photographs and may differ from the prepared drink.

Links to outside sites are provided for information or attribution. We do not control or endorse those sites.

7. Open Food Facts and barcode scanning

Barcode scanning sends the scanned barcode to Open Food Facts. Product names, brands, images, alcohol information, and other details may be incomplete, outdated, or wrong. Check the product label before using a result.

Open Food Facts data is provided under ODbL / CC BY-SA terms and is made available as is. Attribution and licence links appear in Settings > Legal > Acknowledgements.

8. Your content

Recipes, notes, ratings, and photos you create stay on your device, or in your own iCloud if you turn on the optional iCloud Backup, and remain yours unless you choose to share them. We do not receive them, so we need no licence to them. The App has no user accounts, community feed, or developer-hosted user-content service.

The optional iCloud Backup uses your own iCloud account and storage. Whether a backup succeeds, and how long it is available, depends on your iCloud account, your iCloud storage, and Apple's service. It is a convenience, not a guarantee, so keep your own copy of anything you cannot lose.

You are responsible for your content and for having the rights needed to use or share it. Sharing through the iOS share sheet sends the selected content to the person, app, or service you choose.

9. AI recipe import

AI recipe import uses Apple FoundationModels on the device. Pasted text does not leave the device. A generated draft may misunderstand ingredients, quantities, steps, alcohol content, allergens, or safety information. Review the whole draft before saving or making the drink.

10. Prohibited uses

To the extent permitted by applicable law, you must not:

11. Safety and warranties

Read the Safety Disclaimer at drinkbyme.com/safety. You are responsible for deciding whether a recipe, ingredient, technique, substitution, scan result, or imported recipe is suitable for you and your guests.

Recipes are for information and entertainment, not medical, nutritional, or allergy advice. To the fullest extent allowed by law, the App and its content are provided "as is" and "as available." We do not promise that the App will be error-free, uninterrupted, accurate, complete, safe for a particular person, or fit for a particular purpose.

Nothing in these Terms limits rights you have under consumer laws that cannot be excluded.

12. Limitation of liability

To the fullest extent allowed by law, Skydrop Apps LLC is not liable for indirect, incidental, special, consequential, or punitive losses arising from the App or its content.

Our total liability is limited to the greater of the amount you paid us during the 12 months before the event giving rise to the claim or USD 50.

This section does not limit liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.

13. Changes and availability

You can stop using the App and delete it at any time. We may change or discontinue all or part of the App. Sections about safety, warranties, liability, and governing law continue to apply after use ends.

We will post revised Terms at drinkbyme.com/terms, update the effective date, and note material changes in the App Store release notes. Continued use after the revised Terms take effect means you accept them.

14. Governing law and courts

These Terms are governed by the laws of Oregon and applicable United States federal law, without regard to conflict-of-law rules. Subject to mandatory consumer rights, disputes must be brought in the state or federal courts in Oregon. There is no arbitration requirement.

If you are a consumer in the EU, UK, or another country with mandatory consumer law, you keep the protections and courts that law gives you.
